NYS Prevailing Wage Determinations

The 3-Prong Applicability Test
Prevailing wage regulations apply when a contract meets all three: a public agency is party to the contract, public funds are being used, and the work benefits the public.

Labor Law Article 8 (Construction) applies to all public construction, renovation, and reconstruction contracts โ€” with no minimum dollar threshold. Article 9 (Building Service) applies to building service and maintenance contracts, such as janitorial, security, or window cleaning, over $1,500 in or around public facilities.

The 3-Quote Procedure, Done Right

For procurement in the $5,000โ€“$19,999 range, three quotes aren't just collected โ€” they need to be documented in a way that holds up. We help departments implement a version of this process:

  • Step 1 โ€” Detailed Ask: a clear, detailed request laying out exact specifications, terms, and insurance requirements.
  • Step 2 โ€” BCC All Vendors: the inquiry goes out with every vendor BCC'd, creating an immutable, timestamped record of concurrent delivery.
  • Step 3 โ€” Submit Package: the original outgoing email, every vendor response with individual pricing, and a completed quote summary cover sheet, compiled together.

Vendor emails need to include their quotes and be part of the submission package to count toward the required timestamp.
